Bervia Jewellery
Terms of Service
Last updated: [DATE]
These terms apply to all purchases made through berviajewellery.com. By placing an order, you agree to them. They don't affect your statutory rights as a consumer.
01About us
At Bervia Jewellery, we believe jewellery is more than an accessory—it's a timeless expression of style, confidence, and individuality. Our collections are thoughtfully curated to combine modern elegance with everyday wearability, offering beautifully crafted pieces that complement every occasion. From minimalist designs to statement pieces, we are committed to delivering quality, sophistication, and exceptional value. Whether you're celebrating a milestone, finding the perfect gift, or elevating your personal style, Bervia Jewellery is dedicated to helping you shine with pieces designed to be cherished for years to come.
02Our products
We sell fashion jewellery in 316L stainless steel with 18K gold plating, designed to be waterproof, tarnish-resistant and hypoallergenic. Product images are as accurate as we can make them, but colours may vary slightly by screen, and plated finishes can show minor natural variation. Our pieces are decorative fashion jewellery, not fine jewellery, and are not suitable for children under 14.
03Placing an order
When you order, you'll receive an order confirmation email. This acknowledges your order but doesn't constitute acceptance — a contract is formed when we send your dispatch confirmation. We may decline or cancel an order before dispatch (for example, if an item is out of stock, a pricing error has occurred, or we suspect fraud); if we do, you'll be refunded in full.
04Prices & payment
All prices are in pounds sterling (£) and include VAT where applicable. Delivery charges are shown at checkout before you pay. We take payment when you place your order. If we discover a genuine pricing error on an item you've ordered, we'll contact you to confirm at the correct price or cancel with a full refund.
05Delivery
Delivery options, costs and timescales are set out on our Shipping & Delivery page and at checkout. Estimated delivery dates are estimates, not guarantees, though we'll deliver within 30 days unless we agree otherwise. Risk passes to you on delivery; ownership passes when we receive payment in full.
06Cancellations, returns & refunds
Your right to cancel within 14 days of delivery, how refunds work, and the hygiene exemption for earrings and pierced items, are set out in our Returns & Refunds policy, which forms part of these terms. Faulty items are covered by your rights under the Consumer Rights Act 2015.
07Product care
Plated jewellery lasts longest kept away from perfume, cosmetics, chlorine and abrasive surfaces, and stored dry. Damage from misuse, accident or normal wear and tear isn't a fault and isn't covered by refund rights — but if you're unsure whether an issue is a fault, contact us and we'll take a look.
08Our liability
We are responsible for losses you suffer that are a foreseeable result of our breach of these terms or our failure to take reasonable care. We are not responsible for losses that were not reasonably foreseeable or that arise from circumstances outside our reasonable control.
Nothing in these terms excludes or limits any liability or your legal rights that cannot lawfully be excluded or limited, including your rights in relation to faulty, misdescribed or unsafe products, or liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Where permitted by law, Bervia is not responsible for losses arising from the use of our products for business, commercial or resale purposes where our products are supplied for personal and domestic use.
Nothing in these terms affects your statutory rights as a consumer.
09Intellectual property
All intellectual property on this website, including the Bervia name and logo, photographs, images, graphics, product descriptions, text, branding and website content, is owned by or licensed to Bervia and is protected by applicable intellectual property laws.
You may access and use this website for your personal, non-commercial purposes only. You must not copy, reproduce, modify, distribute, publish, sell or commercially exploit any part of our website or its content without our prior written permission.
All rights not expressly granted are reserved.
10Events beyond our control
We will not be responsible for any delay or failure to perform our obligations where this is caused by circumstances outside our reasonable control. These may include severe weather, natural disasters, fire, flooding, strikes, industrial disputes, disruption to postal or delivery services, transport disruption, government action, or other events that we could not reasonably have prevented or anticipated.
If an event outside our reasonable control significantly delays your order, we will contact you where reasonably possible and explain the available options. Where you have a legal right to cancel your order or receive a refund, we will honour that right.
11General
If any provision of these terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or amended to the minimum extent necessary, and the remaining provisions will continue to apply.
These terms are governed by the laws of England and Wales.
If you are a consumer, you will also have the benefit of any mandatory protections available to you under the laws of the country in which you live. Nothing in these terms affects your legal right to bring proceedings in a court where you are entitled to do so.
If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in the courts of Scotland or Northern Ireland, as applicable.
Unhappy with anything? Please contact us first at contact@berviajewellery.com — we'd genuinely like the chance to put it right.
